1. Use of This Website

‍This website is for your personal use to explore and inquire about our photo booth services. You agree not to interfere with the security or functionality of the site, scrape its content, or use it for any unlawful purpose.

‍2. Booking, Retainers, and Payment

Event dates are reserved on a first come, first served basis.

‍Reservation. A signed Service Agreement and retainer of $99 are required to secure your date. The retainer is non-refundable and fill count toward your investment.

‍Purpose of the retainer. ⚠️ The retainer compensates Katha Booth for removing your date from availability, declining other inquiries for that date, and reserving equipment and staff. The parties agree this amount is a reasonable estimate of the harm caused by cancellation, which would otherwise be impractical or extremely difficult to determine. (This framing matters. Under California Civil Code § 1671, a non-refundable sum that functions as a penalty rather than a reasonable estimate of actual damages can be held unenforceable. Have your attorney confirm the amount is defensible.)

‍Balance. The remaining balance is due 14 days before your event date. Service will not be provided if the balance is unpaid.

‍Advertised pricing. ⚠️ Prices shown on this site include all mandatory fees. Optional add-ons are priced separately and clearly disclosed before booking. (California SB 478, effective July 1, 2024, prohibits advertising a price that excludes mandatory charges. If you charge a required travel fee for Orange County events, it must either be built into the advertised price or the advertised price must be presented as a range that accounts for it. This is the single most likely place for you to trip a current California law.)

‍3. Cancellation, Rescheduling, and Force Majeure

‍Cancellation by client. The retainer is non-refundable in all cases. Cancellations received 30 or fewer days before the event forfeit 50% of the contracted total. Cancellations received 14 or fewer days before the event forfeit the full contracted amount.

‍Rescheduling. One date change is permitted at no additional charge if requested at least 30 days before the original date and the new date is available. Rescheduling is subject to a $199 fee thereafter.

‍Force majeure. Neither party is liable for failure to perform due to events beyond reasonable control, including natural disaster, wildfire, earthquake, government order, public health emergency, power failure at the venue, or venue closure. In such cases Katha Booth will offer a credit toward a future date within 12 months.

‍4. Client Responsibilities and Venue Requirements

‍To deliver the service, the client or venue must provide:

  • ‍A level, dry, sheltered space of approximately a minimum 8.5×8.5'FT

  • Access to the setup location at least 2 hours before guest arrival

  • For outdoor events, overhead cover and protection from wind, rain, and direct sun

‍ If these conditions are not met and service cannot be safely delivered, the contracted amount remains due in full.

‍Idle time. If the booth must be non-operational during the booked window at the client's request, idle time is billed at $99 per hour, unless agreed upon ahead of time between all parties.

‍Overtime. Additional hours beyond the contracted window are billed at $149 per hour, subject to availability and a two hour maximum.

‍5. Equipment, Guest Conduct, and Safety

‍Katha Booth equipment remains our property at all times.

‍The client is responsible for the cost of repair or replacement of equipment damaged by guests, including damage caused by intoxicated guests. An estimate will be provided and payment is due within [30] days.

‍⚠️ Our attendant may pause or discontinue service without refund if guests behave in a manner that is unsafe, abusive, or threatening toward our staff or equipment. We will attempt to notify the client or venue coordinator before doing so.

‍Attendant conditions. For events exceeding 3hours, please provide a vendor meal and access to restroom facilities.

‍6. Photography, Likeness, and Media Consent ⚠️

‍This section needs the most attention.

‍What the client grants. The client grants Katha Booth the right to use photographs and video captured at the event in our portfolio, website, social media, and marketing materials.

‍What the client cannot grant. The client cannot consent on behalf of their guests. Under California Civil Code § 3344, using a person's likeness for commercial purposes without that person's consent creates liability, with statutory damages starting at $750 per violation plus actual damages and attorney's fees.

‍How guest consent is obtained. Katha Booth displays a notice at the booth informing guests that photographs may be used for marketing purposes, and provides a means to decline. Guests who decline will not appear in our marketing materials.

‍Private event status. Clients may request Private Event status in writing at least 7 days before the event, in which case no images will be used publicly.

‍Minors. Images of guests who appear to be under 18 will not be used in marketing without written consent from a parent or guardian.

‍7. Guest Contact Information and Messaging ⚠️

‍Guests may provide a phone number or email address at the booth solely to receive their own photographs. That is a transactional message the guest requested.

‍We do not add guest contact information to marketing lists without a separate, affirmative opt-in collected at the booth, unless checked off on received media.

‍(This matters. The Telephone Consumer Protection Act carries statutory damages of $500 to $1,500 per message sent without consent. A single wedding generates enough guest numbers to make that exposure serious. If you ever want to market to guests, the opt-in checkbox at the point of collection is the only safe route.)

8. Delivery and Data Retention

‍Digital galleries are delivered within 3 business days after the event and remain accessible for 3 months. Clients are encouraged to download and back up their files within that period. ⚠️

‍Guest contact information collected for photo delivery is retained for [X] days and then deleted.

9. Intellectual Property

‍All content on this website, including text, imagery, logos, and custom template designs, is the exclusive property of Katha Booth. Reproduction or use without express written consent is prohibited.

‍Clients receive a personal, non-commercial license to use images from their event. Commercial use or resale requires written permission.

10. Privacy ⚠️

‍We handle your information with discretion. Information submitted through our inquiry forms is used solely to respond to your inquiry and provide services. We do not sell or share personal information for cross-context behavioral advertising.

‍You may request access to, correction of, or deletion of your personal information by emailing hell@kathabooth.com. We will not discriminate against you for exercising these rights.

11. Accessibility

‍Katha Booth is committed to making this website accessible. If you encounter a barrier, contact us at hell@kathabooth.com and we will work to resolve it.

12. Limitation of Liability ⚠️

‍Katha Booth maintains professional equipment and carries general liability insurance.

‍Our total liability for any claim arising from our services is limited to the amount paid by the client for those services. We are not liable for indirect, incidental, or consequential damages.

‍Nothing in these terms limits liability for fraud, willful injury, gross negligence, or violation of law.

‍Equipment failure. In the unlikely event of equipment failure preventing service, our liability is limited to a refund proportional to the time the booth was non-operational.

‍13. Dispute Resolution and Governing Law

‍These terms are governed by the laws of the State of California.

‍Any dispute shall be resolved in the state or federal courts located in Los Angeles County, California, and both parties consent to that jurisdiction.

‍Either party may pursue a claim in small claims court where the amount qualifies.

‍14. Changes to These Terms

‍We may update these terms as our business evolves. Updates will be posted here with a revised "Last Updated" date. Material changes will not apply retroactively to signed contracts.
